These SMS Terms & Conditions (“SMS Terms”) describe how Attend OpCo LLC d/b/a Attend Home Care (“Attend Home Care,” “we,” “us,” “our”) sends text messages (SMS/MMS). By providing your mobile number and opting in, you agree to these SMS Terms.

1) What Messages You May Receive

Depending on your relationship with us (client/prospective client, family member, caregiver/applicant, referral partner), messages may include:

Responses to your inquiries

Scheduling and appointment reminders

Care coordination updates and service communications

Program information you requested (including eligibility navigation and next steps)

Caregiver recruiting, onboarding, and shift-related updates (for applicants/caregivers)

Customer support and administrative notices

Marketing messages (only where permitted and based on your consent/choices)

Message frequency varies based on your activity and requests.

2) Consent

When you submit your phone number through our website, forms, ads, intake processes, phone calls, or other channels, you are authorizing Attend Home Care to contact you by text message at that number. We may use automated technology where permitted by law.

Your consent is not required to receive services or to apply for a job. If you prefer not to receive texts, use the opt-out method below.

3) Opt-Out / Help

STOP: Reply STOP to opt out at any time. You may receive one final confirmation message.

HELP: Reply HELP for basic assistance.

Re-subscribe: Reply START (or re-opt-in through our forms) to resume messages.

4) Message & Data Rates

Message and data rates may apply based on your carrier plan. Carriers are not liable for delayed or undelivered messages.

5) Privacy

We use your phone number and message content to communicate with you and provide services. We do not sell your mobile number. Our handling of personal information is described in our Privacy Policy.

If text messages include or relate to Protected Health Information (“PHI”), we will handle that PHI in accordance with our HIPAA Notice of Privacy Practices and applicable law. Please avoid sending highly sensitive medical details by text unless we specifically request it for care coordination.

6) Eligibility

By opting in, you confirm you are the subscriber or authorized user of the phone number provided and are at least 18 years old. If your number changes, you agree to notify us.

7) Changes to These SMS Terms

We may update these SMS Terms from time to time. Updates will be posted with a new effective date. Continued participation after updates means you accept the revised terms.

This State Privacy Law Addendum supplements the Attend Home Care Privacy Policy and HIPAA Notice of Privacy Practices. It applies to residents of the states listed below and describes additional rights provided under applicable state laws. Residents of Pennsylvania, Ohio, Wisconsin, Kentucky, and Georgia are entitled to protections under applicable state data security and breach notification laws. Attend Home Care provides notice of data breaches and maintains reasonable safeguards as required by these laws.

2. HIPAA Notice of Privacy Practices (NPP)

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED, AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY. This Notice applies to Attend OpCo LLC d/b/a Attend Home Care and our workforce members (including employees, contractors, and caregivers) who need access to PHI to perform their duties. Protected Health Information (“PHI”) is information about you that may identify you and relates to your past, present, or future physical or mental health or condition, the provision of health care to you, or payment for that care.

2.1 Our Duties

We are required by law to: • Maintain the privacy and security of your PHI • Provide you with this Notice • Follow the terms of this Notice currently in effect • Notify you following a breach of unsecured PHI • Use or disclose only the minimum necessary PHI for a given purpose, when required by HIPAA

2.2 How We May Use and Disclose PHI Without Your Authorization

A) Treatment

We may use and disclose your PHI to provide, coordinate, or manage your care and related services.

B) Payment

We may use and disclose PHI to bill and receive payment for services, including eligibility checks, claims submission, utilization review, and collection activities.

C) Health Care Operations

We may use and disclose PHI for our operations, such as quality assessment and improvement, training, supervision, licensing, accreditation, auditing, and compliance.

D) Individuals Involved in Your Care

Unless you object, we may disclose relevant PHI to family members, caregivers, or others involved in your care or payment for your care, consistent with applicable law.

E) Public Health and Safety Activities

We may disclose PHI for public health activities (as permitted), reporting abuse/neglect/exploitation, preventing serious threats to health or safety, or other legally authorized purposes.

F) Required by Law; Legal Proceedings; Law Enforcement

We may disclose PHI when required by law, in response to valid legal process, or to law enforcement as permitted by HIPAA.

G) Health Oversight Activities

We may disclose PHI to oversight agencies for audits, investigations, inspections, and licensing activities.

H) Workers’ Compensation

We may disclose PHI as authorized by workers’ compensation laws or similar programs.

I) Coroners, Medical Examiners, and Funeral Directors

We may disclose PHI to coroners, medical examiners, and funeral directors as permitted by law.

J) Organ, Eye, and Tissue Donation

We may disclose PHI to organ procurement organizations or entities engaged in organ, eye, or tissue donation and transplantation.

K) Research (Limited Circumstances)

We may use or disclose PHI for research as permitted by HIPAA, such as with your authorization or when an Institutional Review Board (IRB) or privacy board approves a waiver.

L) Business Associates

We may disclose PHI to vendors who perform functions on our behalf (“Business Associates”). Business Associates must agree in writing to protect PHI.

2.3 Uses and Disclosures That Require Your Written Authorization

We will not use or disclose your PHI for the following without your written authorization, except as permitted by law: • Most marketing communications • Sale of PHI • Psychotherapy notes (if applicable) You may revoke an authorization at any time by submitting a written revocation, but revocation will not affect actions already taken.
